GENERAL CONDITIONS OF SALE

Tsunami Nutrition Srl a sole shareholder, with registered office in via Marcandreola, 5 - 00043 Ciampino (Rome), VAT number 14212051008, RM - 1504370, is the owner of the website www.tsunaminutrition.it and all its contents.

1. GENERAL CONDITIONS The following terms of sale apply to all Users (or Customers) who use the above site by accessing via any mobile device. Upon acceptance of the order by Tsunami Nutrition Srl, the User declares to have read, understood and accepted the terms and conditions below (including thePrivacy Policy). The order form will be stored in the database of Tsunami Nutrition S.r.l for the time necessary for the execution of the same and, in any case, within the terms of the law. The user will be able to access the order form and/or the data related to the same through their personal account available on the website www.tsunaminutrition.it.

2. ACCEPTANCE OF THE GENERAL TERMS OF SALE The contract entered into between Tsunami Nutrition Srl and the Client is understood to be concluded with the acceptance of the order (even if only partial) by Tsunami Nutrition Srl. Once the order has been placed, the Client is invited to keep a copy of the purchase form and these general conditions of sale.

3. IMAGES The images accompanying the product description sheet are for illustrative purposes only and, despite the search for accuracy for resemblance to the original colors, may not be perfectly representative of the actual features. Indeed, it cannot be guaranteed that the device used to navigate the site will make the colors appear in the exact manner. It is, however, possible that the image undergoes variations, updates of graphics and product ingredients, decided by the manufacturing company.

4. PRODUCT A VAILABILITY Product availability refers to the actual availability at the time the Customer places the order. It is to be considered purely indicative because, given the simultaneous presence on the site of several users, the chosen products could be sold to other Customers before the confirmation of the order.
In case of lack of availability, total or partial, at the time of order confirmation, the order will be automatically rectified with the elimination of the unavailable product(s) and the Customer will be promptly informed by e-mail. During the period of June - September we do not recommend the purchase of chocolate bars or snacks; these products are stored in Tsunami Nutrition Srl. warehouses at a controlled temperature, however, during transport by the courier, despite the specific care taken by Tsunami Nutrition Srl, such as the use of Cryo Bag when packing the package, this type of product could go through stages of melting, Tsunami Nutrition S.r.l. will not be responsible for the arrival at destination of this type of product not intact or melted.

5. PURCHASING METHODS AND PRICES The Customer may only purchase products in the electronic catalog of Tsunami Nutrition Srl and viewable on the site www.tsunamitrunition.it at the time of placing the order. The aforementioned site contains product information sheets, price, payment methods that can be used, methods and expected delivery times together with a reference to these general conditions that are considered accepted the moment the seller communicates confirmation of the order. The selected products will be added to the shopping cart. It will then be sufficient to follow the purchase instructions, entering and verifying the required data at each step, these can still be changed before payment. Upon receipt of the order, the Customer will receive a confirmation e-mail to the address indicated. The price of the products includes VAT and does not include shipping costs, which may vary depending on the place of delivery indicated by the Customer (in this regard, please refer to the table in the "Shipping and Delivery" section). The price may change at any time, the change does not affect orders for which confirmation has already been sent.

6. METHOD OF PAYMENT Payment of the goods by the Customer will be made using the method chosen at the time of the order.

6.1 Credit Card In cases of purchase of goods with mode of payment Credit Card, at the conclusion of the online transaction, the bank of reference will authorize only the commitment of the amount of the purchase made. At no time during the purchase procedure Tsunami Nutrition Srl is able to know the data to the Customer's credit card, these are transmitted via secure connection directly to the site of the banking institution handling the transaction and will not be stored by Tsunami Nutrition Srl.

6.2 Cash on delivery Payment is made with cash to the courier who will deliver the goods. The service is only active in the Italian territory.

6.3 Sc alapay If you buy with Scalapay you receive your order immediately and pay in 3 installments. You acknowledge that the installments will be assigned to Incremento SPV S.r.l., related parties and their assignees, and that you authorize such assignment.

6.4 PayPal In cases of purchase of goods with PayPal payment method, simultaneously with the conclusion of the online transaction, PayPal will immediately charge the amount related to the purchase made. Registration with PayPal is not mandatory, you can use the service at any time by entering your credit card information. Using this payment method, you can use the following credit cards: Visa, MasterCard, PayPal Prepaid Card, PostePay, Discover, American Express Carta Aura, Maestro.

7. ORDER MANAGEMENT Orders are processed within 24/48 hours after the order is received. Any free gifts included in the order may vary depending on availability at the time of order processing. No exchange, not even a size change, is available for free gifts. Regarding the treatment of packages not delivered by the courier, not delivered to the final recipient it is specified that in cases of:

  • Unknown addressee or address anomaly, that is, in cases where the package is returned to the sender by the courier for the following reason: "the addressee does not live at the given address." Following the receipt and acceptance of the package by our services, Tsunami Nutrition will contact the customer to resend the order or proceed with a refund, depending on the customer's choice. Tsunami Nutrition reserves the right to proceed with a refund instead of resending the order if multiple items returned to the sender with unknown recipient are detected.
  • Recipient "ABSENT/LEAVED NOTICE", i.e., in the event that the package is returned to the sender by the courier because it was not picked up by the customer at the courier's location or at the delivery point within the time limit. Following receipt and acceptance of the package by our services, Tsunami Nutrition will contact the customer to resend the order or proceed with a refund, depending on the customer's choice. Tsunami Nutrition reserves the right to process a refund instead of resending the order if multiple returned items with unknown recipient are detected.

8. DELIVERY METHODS Tsunami Nutrition Srl ships to Italy and abroad to the countries listed in the "Shipping and Delivery" section. As required by Presidential Decree No. 696 of 21 December 1996, each package shipped is accompanied by the relevant Transport Document and will be delivered by courier to the address indicated by the Customer. It is therefore essential to take care to fill in the shipping form exactly by entering the recipient's data in a unique manner. The Invoice must be requested at the same time as the order by writing to Customer Service specifying all necessary tax data and will be available on the Customer's tax drawer. For the protection of the consumer, as prescribed by art. 63 Cod. Cons., as amended by Legislative Decree 21/2014, it is recalled that in contracts that place on the professional the obligation to provide for the shipment of goods, the risk of loss or damage of the goods, for reasons not attributable to the seller, is transferred to the consumer only at the time when the latter, or a third party designated by him and different from the carrier, materially takes possession of the goods. For anything not expressly set forth in this article, please refer to the section "Shipping and Delivery".

9. RIGHT OF WITHDRAWAL AND REFUND The Customer has the right to withdraw without penalty and without specifying the reason, within the period of fourteen days from the time of receipt of the goods. The right shall be exercised by sending a written notice to the e-mail address in Section 15. The model return form to exercise the right of withdrawal can be downloaded here. The right of withdrawal cannot be partial, but applies to the product in its entirety, which must be returned intact or in normal state of preservation, as kept and possibly used with the use of normal diligence. This last part does not apply to products for food use. The product is deemed to be returned at the time it is delivered to the accepting post office or freight forwarder. The only costs payable by the consumer for the exercise of the right of withdrawal are the direct costs of returning the product to Tsunami Nutrition Srl, which will refund as soon as possible and in any case within fourteen days from the time of the manifestation of the Customer to want to exercise the right of withdrawal and by PayPal in the event that it is the mode chosen by the Customer at the time of the order. In the event that the Customer has opted for a different method of payment, he will be given a voucher within 72 hours of the request for the purchase of products of his choice within 30 days of the issuance of the voucher. For the processing of this type of data, please refer to the Privacy section. In case of anomalies in the delivered goods attributable and not to the shipping courier, the Customer must send photographic evidence of the same to the addresses indicated in Article 15 below. Tsunami Nutrition Srl will contact the Customer to arrange the return and/or eventual refund. For anything not expressly stated in this article, please refer to the section"Returns and Refunds".

10. CONFORMITY GUARANTEE - LEGAL GUARANTEE The provisions of this article apply exclusively to Customers who have the status of consumer under Article 3, paragraph 1, lett. a), Consumer Code. Tsunami Nutrition undertakes to sell to the Customer its products marketed in accordance with the purchase order transmitted by the latter, it being understood that there is no lack of conformity if at the time of receipt by the Customer of the confirmation of the order, the Customer was aware of such defect or could not ignore it using ordinary diligence or if the lack of conformity arises from instructions or materials provided by the Customer. In the event of conformity defects found in the products purchased from Tsunami Nutrition, the Client must contact immediately and in writing - and in any case within 60 days - the Customer Service in the manner indicated in point 15, in order to report the conformity defect found, providing the Customer Service with documentary evidence (by which is meant also photographic reliefs) of the conformity defect found. Tsunami Nutrition - in compliance with legal and warranty obligations will proceed with the verification of truthfulness of the purchaser's statements. At the outcome of the verification of the defect, the Customer has the right, at its option and within the limits of the provisions of the Consumer Code, to the restoration, without charge, of the conformity of the Products by repair or replacement, or to an appropriate price reduction. It is also recognized to the Customer, as an alternative to the remedies described herein, the right to request from the Seller the issuance of a voucher of an amount equal to that of the Products purchased non-compliant and of the validity that the Customer may use for subsequent purchases made through the Tsunami Nutrition website. The repair or replacement of the product will take place within 30 days of receipt of the defective product. To this end, the Client may use the standard withdrawal form (downloadable by clicking here); the Client, in the attached form, must absolutely indicate one of the following reasons given for the return: product not in conformity with what was ordered; damaged product; defective/not correctly functioning product; product arrived in addition to what was ordered; product with missing parts; other causes. The products marketed by Tsunami Nutrition are covered by the legal warranty of 24 months from delivery if used by the Client in accordance with the indications given on the Product Sheets; it is understood that the Client shall forfeit the rights referred to in this Article if he/she does not report the lack of conformity to the Seller within the term of 2 months.

11. DATA PROC ESSING The data requested at the time of purchase are processed in accordance with the provisions of European Regulation 679/2006 on data protection and the relevant national legislation in force. The Customer is invited to read the fullPrivacy Policy.

12. RESPONSIBILITY On all stages of access to the site, consultation, form filling, order execution, delivery of items or on any other service, the company Tsunami Nutrition Srl assumes only an obligation of intermediation. Therefore, Tsunami Nutrition Srl declines any responsibility for inconveniences or damages derived from the use of the Internet network and totally unrelated to the obligations and precautions taken by Tsunami Nutrition Srl. In particular, all contingencies related to the provision of the service, external intrusions or the presence of computer viruses will not be attributable to Tsunami Nutrition Srl. Similarly, anything that turns out to be a cause of force majeure within the meaning of what has been established by the Supreme Court totally exonerates Tsunami Nutrition Srl from any responsibility. Customers enjoy the guarantees provided by the brands on the site.

13. APPLICABLE LAW AND COMPETENT COURT These conditions of sale are governed by Italian law and are to be interpreted according to it. For anything not explicitly established in them, please refer to the relevant national legislation in force. In case of disputes, the competent court of jurisdiction is that of the Customer's residence/domicile. Pursuant to Article 14 of Regulation 524/2013, the user is informed that in the event of a dispute he/she may file a complaint by means of the ODR platform of the European Union that can be reached at the following link http://ec.europa.eu/consumers/odr/.
